JUDGMENT / ORDER

We have heard Mr. Alok Thakkar, learned counsel for the appellant and Mr. Rakesh R. Patel, learned Assistant Government Pleader, appearing for the respondents. Counsel for the parties have agreed that this appeal can be disposed without calling for any counter affidavit. The learned Single Judge has limited the writ petition only qua the benefit of last three years. A writ petition may be admitted or it may be dismissed but it cannot be restricted and relief can be restricted only at the stage of final hearing and not at the time of admission. In this view of the matter, order dated 05/09/2012 cannot be maintained. This Letters Patent Appeal is allowed. The order dated 05/09/2012, passed by the learned Single Judge in Special Civil Application No. 9012 of 2012 is set aside. The matter is remanded back to the learned Single Judge with a request to consider the writ petition for admission. [ V. M. Sahai, J. ] [ G. B. Shah, J. ] hiren
