(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Mr.Rakesh Patel, learned Assistant Government Pleader appearing for the appellants and Mr.Samir Gohil, learned counsel appearing for the respondent.
2. Learned Assistant Government Pleader has urged that after the minor became major, he could not make an application for compassionate appointment within a period of two years and he should have made an application immediately he became major. The learned Single Judge has relied upon the decision of this Court wherein the policy of the year 2000 of the General Administration Department with regard to compassionate appointment has been considered and it has been held that a minor, after becoming major can make an application for compassionate appointment within a period of two years. This decision was affirmed also in the Letters Patent Appeal. On this basis, the learned Single Judge has allowed the writ petition and has directed to consider the claim of the petitioner for compassionate appointment. We do not find any illegality in the impugned order passed by the learned Single Judge. This Appeal is devoid of any merits and is accordingly dismissed. Civil Application is also dismissed.
