JUDGMENT / ORDER

Date : 23/03/2012 1. Present Civil Revision Application under section 115 of the Code of Criminal Procedure has been preferred by the petitioners - State of Gujarat and another to quash and set aside the impugned order dtd.11/3/2010 passed by the learned Senior Civil Judge, Gondal in Regular Civil Suit No.223 of 1995, by which the learned trial court rejected the said application submitted by the petitioners to reopen the right to cross- examine the witnesses.
2. Today when the present revision application is taken up for final hearing, it is reported that the main Suit itself is disposed of by the learned trial court. Therefore, present revision application has become infructuous.
3. Under the circumstances, without further entering into the merits of the case and/or expressing any opinion on merits with respect to the impugned order, present Civil Revision Application is dismissed as having become infructuous. It will be open for the petitioners to make appropriate grievances before the appellate forum, in case any appeal is preferred against the judgement and decree passed in Regular Civil Suit No.223 of 1995. With this, present Civil Revision Application is dismissed as having become infructuous. Rule is discharged.
