(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Ms. Paurami B. Sheth, learned counsel for the appellant, Mr. D. G. Shukla, learned counsel for the respondent No. 2 and Mr. Rakesh R. Patel, learned Assistant Government Pleader, appearing for respondent No. 1.

Counsel for the parties agree that the controversy involved in this Letters Patent Appeal is covered by the decision of this Court in Letters Patent Appeal No. 925 of 2012 in Ashokkumar Jashubhai Solanki Vs. Gujarat Public Service Commission and Other, decided on 10/09/2012. The only difference being the change in the caste – category. Earlier decision was with regard to the SEBC category candidate and in the instant case, the candidate is of General category.
3. Therefore, for the reasons given in the aforesaid judgment and order, this appeal is dismissed being covered by the aforesaid decision, along with Civil Application. Parties shall bear their own costs.
