(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Mr. J. A. Adeshra, learned counsel for the appellant and Mr. Rakesh R. Patel, learned Assistant Government Pleader, appearing for the respondents. This Letters Patent Appeal has been filed challenging order of the learned Single Judge dated 03/09/2012, passed in Special Civil Application No. 11245 of 2012.
2. In response to the Notice issued in this appeal, the respondents have filed affidavit in reply. Interest of justice would be served if we request the learned Single Judge, who has already expedited the hearing of the writ petition, to hear the writ petition on merits and may also take into consideration the affidavit in reply filed by the respondents in this appeal and such other documents, as the learned Single Judge wants to take into consideration. This appeal is disposed of with a request to the learned Single Judge to decide the writ petition filed by the petitioner expeditiously, preferably with a period of one week, subject to His Lordship's convenience.
2.1 One post, which has been kept vacant in pursuance to the interim relief granted in this appeal, shall be subject to the final decision of the writ petition.
2.2 In view of the main Letters Patent Appeal is disposed of, no orders are required to be passed on Civil Application. The same is also disposed of accordingly.
