Divakar Maddur M, HCGP) This criminal petition is filed under Section 438 of Cr.P.C., praying to enlarge the petitioner on bail in the event of his arrest in Cr.No.358/2018 of Bilikere Police Station, Mysuru District for the offence punishable under sections 465, 420, 468, 381 r/w 34 of IPC.
This petition coming on for orders this day, the Court made the following;
ORDER Bilikere police, Hunsur Taluk, Mysore District have registered Cr.No.358/2018 against the petitioner and accused No.1 for the offences punishable under Sections 465, 420, 468, 381 r/w 34 of IPC.
2. Petitioner was working as attendar in Maradur Grama Panchayath Office of Hunsur Taluk. It is alleged that the accused in collusion with others forged the property register and interpolated the name of accused No.1 for the properties bearing Janger Nos.59, 66, 68 of Maradur Grama Panchayath, thereby attempted to make wrongful gain for accused No.1.
3. It may be true that offence does not carry capital punishment. The case is still at the stage of investigation. The material on record indicates that the petitioner was implicated in the case on the basis of the CC T.V. footage available in the Grama Panchayath Office. Petitioner is required for custodial investigation to unearth the involvement of other persons in the case.
4. Having regard to the stage of the case and nature and implications of the offences, it is not a fit case to grant anticipatory bail. Therefore, petition is dismissed.
