JUDGMENT / ORDER

Hon'ble Rajesh Chandra,J.
Application of the bank for attachment of the property in question is pending before the Debt Recovery Tribunal. The bank apprehends that respondent no.2 may transfer the property qua which attachment has been asked for, before the application is considered.
The writ petition is misplaced as any transfer in between would be subject to the doctrine of dis-pendis and the Bank can always take recourse to the same before the Tribunal. The Writ Petition is, therefore, dismissed. However, it is open to the petitioner to seek redressal of his grievance before the Tribunal itself where its attachment application is pending.
