O R D E R:
Heard learned counsel for the petitioner and learned standing counsel for the first respondent.
2. This writ petition was filed challenging the action of the first respondent in passing the order dated 23.10.2008 vide Ref.No.52Q/15133-82 holding the petitioner bank as well as the Manager as ‘deemed defaulters’ under the provisions of the ESI Act, 1948, and demanding to deposit an amount of Rs.1,24,440/- from the loan account of the 2nd respondent.
3. The learned standing counsel for the first respondent submits that the E.S.I.Case No.11 of 2009 is closed under the amnesty scheme offered by the first respondent and no proceedings are pending so far as the 2nd respondent is concerned. In view of the same, it is also stated that they will not pursue the order dated 23.10.2008 against the petitioner.
4. Recording the said submission, the writ petition is closed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
