JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE TWENTY SIXTH DAY OF DECEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 39004 of 2014 BETWEEN P.Dastagiri AND ... PETITIONER The State of Andhra Pradesh, Rep. by its Superintendent of Police, Kurnool District, Kurnool.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. The grievance of the petitioner is that in spite of his complaints, dated 31.10.2014, 11.11.2014 and 26.11.2014, no crime is registered against respondent No.6 and no investigation is taken up.
3. Instructions received by the learned Government Pleader from respondent Nos.3 and 4 show that as per the complaint forwarded for investigation and report, under Section 156 (3) Cr.P.C. from the competent criminal court, crime was registered viz., Crime No.197 of 2014 on 28.08.2014 on the file of Kodumuru Police Station and investigation is taken up. It is stated that so far six witnesses were examined and their statements were recorded and the investigating officer has already obtained report from the Tahsildar, Kodumuru and that a further report from the Sub-Registrar, Gudur, is awaited. It is stated that as soon as the investigation is completed, appropriate report would be filed.
4. Evidently, the contention of the petitioner that no crime is registered and no investigation is taken up is factually incorrect and the investigating officer has already completed substantial part of the investigation.
5. In view of that, no further orders are necessary except directing respondent Nos.3 and 4 to complete the investigation as expeditiously as possible and file their report before the jurisdictional court.
With the above direction, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
