JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE TWENTY SIXTH DAY OF DECEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.39101 of 2014 BETWEEN P.V.S.P. Murthy Raju AND ... PETITIONER The State of Andhra Pradesh, rep. by its Principal Secretary, Home Department, Secretariat Buildings, Hyderabad and others ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. This writ petition is filed alleging that respondent No.3 is interfering with the petitioner’s land admeasuring Ac.18-32 cents in Survey No.21/13 of Morampudi Village, Rajahmundry Rural. Petitioner also states that there is a civil dispute between him and respondent No.4. However, there is no complaint or crime registered against the petitioner and, as such, respondent No.3 has no jurisdiction to interfere with the civil rights of the petitioner.
3. Instructions received from the learned Government Pleader show that as on the date of instructions i.e., 22.12.2014, there was no crime registered nor complaint received against the petitioner and that the dispute between the petitioner and respondent No.4 being of a civil nature, police have nothing to do with it. It is, however, stated that if and when any complaint is lodged, the respondent-police are duty bound to act in accordance with law on such complaint.
4. Since the allegation of the petitioner relating to interference in civil dispute is specifically denied stating that police have nothing to do with the civil dispute between the petitioner and respondent No.4, the same is recorded and no further orders are called for in this writ petition.
Writ petition is, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
