JUDGMENT / ORDER

Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.

This writ petition has been filed praying for a writ of Certiorarified Mandamus, calling for the records in respect of the impugned order passed by the 1st respondent, vide his proceedings, in Na. ka. No.2885/E3/2009, dated 20.6.2009 and quash the same and direct the 1st respondent to approve the list of teaching staff for the additional intake submitted by the petitioner on 27.1.2009, for the academic year 2009-2010"

Even though the prayer in the Writ Petition sought is for a larger relief, the learned counsel for the petitioner had submitted that it would suffice if the impugned order, dated 20.6.2009, in Na.Ka.No.2885/E3/2009, is set aside and if the petitioner is permitted to make a fresh representation furnishing additional particulars regarding the existing staff members for the original intake of 50 students, as required by the first respondent, within one week from today and if the first respondent is directed to consider the request of the petitioner institute for granting the necessary approval of the list of the staff members, submitted by the petitioner Institute, on 27.1.2009, for the additional intake of 50 students and to pass appropriate orders thereon, on merits and in accordance with law.
4. The learned counsel appearing on behalf of the respondents has no objection for this Court passing such an order.
5. In view of the submissions made by the learned counsels appearing on either side, the impugned order of the first respondent, dated 20.6.2009, is set aside and the petitioner is permitted to furnish additional particulars, regarding the list of existing staff members, in respect of the original intake of 50 students in the petitioner Institute, along with the additional particulars, required by the first respondent, within one week from the date of receipt of a copy of this order. On submission of the additional particulars by the petitioner Institute, the first respondent is directed to consider and pass appropriate orders thereon, within one week thereafter.
With the above directions, the writ petition stands disposed of. No costs.
