JUDGMENT / ORDER

The petitioner was a surety to a loan, in default of which, proceedings were initiated under Section 37 of the Kerala Co-operative Societies Act, 1969. The petitioner is said to have retired in the year 2000 itself. The writ petition filed challenging the recovery against the salary has become infructuous. However, if any recovery is proceeded against the petitioner, on the basis of the surety agreement, then necessarily it shall be with notice to the petitioner. The writ petition is dismissed as infructuous without prejudice to the contentions of either parties.
