S.Suganya vs N.Murali

Madras High Court|23 February, 2017

JUDGMENT / ORDER

This petition for transfer is filed by the wife in a matrimonial proceedings (F.C.O.P.No.379 of 2014) filed in the year 2014. It is seen that there has been a steady progress in the said case. The trial was over and the F.C.O.P. is stated to have been posted for arguments. The husband's side arguments were also over. Thereafter, the wife seems to have filed I.A.No.579 of 2016 for reopening of the case, which has also been allowed on 07.12.2016. Subsequently, the wife has filed this Tr.C.M.P. and also obtained an order of interim stay on 19.12.2016. Unnecessarily, the matter is kept pending for a year. When it is only the side of the arguments of the wife is pending, no useful purpose would be served in transferring F.C.O.P.No.379 of 2014 to any other Court. Finding no merits, this Tr.C.M.P. is dismissed. The learned Judge, Family Court, Salem is directed to dispose of the said F.C.O.P. on or before 31.03.2017. No costs. C.M.P. is closed.
