JUDGMENT / ORDER

The wife who is the respondent in H.M.O.P.No.18 of 2017 filed by the husband seeking divorce on the ground of cruelty, seeks transfer of the said proceedings to the file of Sub-Court, Virudhunagar.
2.In the affidavit filed in support of the Transfer petition, it is stated that the wife is living in Soolakarai Village, Virudhunagar Taluk with her aged parents and she has to take care of her two sons also. The transfer is sought for mainly on the ground of convenience, as the distance between Thoothukudi and Virudhunagar is about 100 Kms.
3.The respondent/husband has been served on 2.5.2017. Despite notice, he has not chosen to appear either in person or through his counsel, duly instructed.
4.Considering the averments made in the affidavit filed in support of the Transfer Petition and the fact that the said averments has not been disputed by the respondent/husband by entering appearance before this Court, the Transfer Civil Miscellaneous Petition is allowed and the H.M.O.P.No.18 of 2017 on the file of Sub-Court, Thoothukudi is transferred to the file of Sub-Court, Virudhunagar. The Sub-Court, Thoothukudi is directed to transmit the papers in H.M.O.P.No.18 of 2017 within two weeks from the date of receipt of a copy of this order, to the file of Sub-Court, Virudhunagar. Consequently, connected Miscellaneous Petition is closed. No costs.
