S.Saravanan vs G.Nagajothi

Madras High Court|25 January, 2017

JUDGMENT / ORDER

The revision petition is filed by the husband in a matrimonial dispute seeking to dispose of H.M.O.P.No.3404 of 2011 within a time frame. It is seen from the records that though the cross-examination has commenced as early as on 12.08.2015, till today, there seems to be no progress in the case, and hence, the petitioner has approached this Court. Normally, when once the trial has commenced, the Court is expected to take up the matter on day-to-day basis and complete the trial. In this case, though it is the Family Court and the proceedings are summary in nature, but still, allowing the cross-examination to go on without any progress for more than 1-1/2 years, is deprecated. This Court is of the view that the O.P. has to be disposed of. Accordingly, H.M.O.P.No.3404 of 2011 shall be disposed of by the learned First Additional Principal Judge, Family Court, Chennai, on or before 30.04.2017. With this direction, the Civil Revision Petition is disposed of. No costs.
25.01.2017 cs Copy to The First Additional Principal Judge, Family Court, Chennai.
