S.R.P.H. Rajashekar Raja vs 4 The Land Acquisition Officer &

Madras High Court|15 March, 2017

JUDGMENT / ORDER

The petitioner, being the erstwhile land owner, approached the District Collector, seeking reconveyance on the premise that the lands have not been put into use. The request made was rejected by the proceedings of the District Collector viz., the second respondent dated 14.04.2016. The petitioner, after collecting some more materials including the documents to show that notices have been issued to the beneficiaries for cancellation of patta issued for non-compliance of the conditions mentioned, sought for return. As the said application has not been considered, the present writ petition has been filed.
2.Though, in law, no review is available, there is no bar for considering the request of the petitioners afresh. In such view of the matter, without going into the merits of the case, the petitioner is directed to give further representation within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the second respondent is directed to pass appropriate orders on merits and in accordance with law, within a period of eight weeks thereafter. The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
