Heard learned counsel for the applicants and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicants, Sriram Chauhan, Suman Devi @ Smt. Suman Chauhan, Baburam Chauhan @ Rambabu, Bharat Chauhan and Ashok Kumar, with a prayer to release him on bail in Case Crime No. 458 of 2019 , under Sections- 406,420 I.P.C., Police Station- Sahjanwa, District- Gorakhpur , during pendency of trial.
The violation of contract of supply of labour has been alleged in the First Information Report.Learned counsel for the applicants alleges false implication.
Learned A.G.A. has pointed out that money has been transferred in the account of the applicants.
The allegations against the applicants show that they are involved in economic offences. The Apex Court in the case of Directorate of Enforcement Vs. Ashok Kumar Jain (1998) 2 SCC 105, has held that in economic offences, the accuseds are not entitled to anticipatory bail.
The anticipatory bail application is accordingly, rejected.
