Soorya, Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying to issue a WRIT OF HABEAS CORPUS or any other order or direction in the nature of writ directing the respondents 1 to 4 to produce the detenu namely Nandhini Daughter of Srinivasan, who is minor girl aged about 14 years, before this Hon'ble court who has been unlawfully and illegally detaining by the 5th respondent against her will from 27-11-2016 onwards and set her free at liberty and thereby ensure their Right to Life and Personal Liberty as Guaranteed under Article 21 of constitution of India.
[Order of the Court was made by S.NAGAMUTHU.J] Alleging that his daughter, by name Ms.Nandhini aged 14 years has been found missing from 27.11.2016 onwards, the petitioner has come up with this Habeas Corpus Petition.
2. Today, when the matter was taken up for hearing, the petitioner made appearance and the respondent Police has also made appearance. The Inspector of police has stated that the detenue was all along at the house of her Aunt in Andhra Pradesh and she returned home, on her own. He would further submit that no offence whatsoever was committed against her. He would further submit that in fact, the detenue was produced before the District Child Welfare Committee and the said Committee has also passed order in this regard. The said statement is recorded.
3. In view of the above, this Habeas Corpus Petition is dismissed as infructuous.
