PRAYING TO ENLARGE THE PETITIONER ON BAIL IN CR.NO.195/2016 (S.C.NO.58/2016) OF BIDADI POLICE STATION, RAMANAGARA DISTRICT FOR THE OFFENCE PUNISHABLE UNDER SECTIONS 201, 302, 376 OF IPC.
THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent-State.
2. The petitioner is charge sheeted by the respondent Police in their Crime No.195/2016 in respect of offences punishable under Sections 201, 302, 376 of IPC 3. The allegation is, the petitioner though was a married person had affair with the deceased Lakshmidevi @ Suma. Since the victim insisted him to marry her, on 28.04.2016, he made her to consume alcohol, took her to Megalamodde Village, Bidadi Hobli, Ramanagara Taluk doused her with diesel and set her ablaze. Petitioner was arrested on 06.05.2016. On his disclosure, mahazar was conducted at the place of offence. The other piece of incriminating evidence is statement of the shop keeper (CW5) who sold diesel and match box to the accused.
The investigation since complete, in the given circumstance there is no impediment to allow the petition.
4. Accordingly, petition is allowed. Petitioner is enlarged on bail in Crime No.195/2016 registered by the respondent-police, subject to the following conditions:-
i) He shall execute a self bond for a sum of Rs.2,00,000/- (Rupees Two Lakhs only) with two local sureties for the like sum to the satisfaction of the concerned Court.
ii) He shall attend the Court regularly on all the hearing dates.
