Heard learned counsel for the petitioner and learned Government Pleader for Home appearing for the respondents.
2. The petitioner theatre was constructed more than 25 years back and was renovated from time to time. At the time of filing the writ petition the admission rates for first class is Rs.35/-, second class is Rs.25/- and for third class is Rs.10/-. Earlier, the Government of Andhra Pradesh permitted enhancement of admission rates for the higher class, but subsequently in the year 2008 restricted the rates of admission basing on the local area as Rs.25/-. Challenging the same, the theatre managements filed W.P.Nos.143 of 2009 and batch out of which in two writ petitions there were interim orders granted initially and later on vacated. The writ appeals preferred against vacating the interim orders were disposed of. When the writ petitions were pending consideration, respondents 2 and 3 insisted the petitioner to reduce rates from Rs.35/- to Rs.25/-. Some of the petitioners filed W.P.No.28930 of 2010 and the said writ petition was disposed of directing the authority to consider the representation of the petitioners for fixing the rates as per G.O.Ms.No.538 dated 11.07.1994 where liberty was given to the management of the theatre and the representation was pending before the Government. Challenging reduction of the rates, the present writ petition was filed.
3. Since no interim order was granted in the present writ petition, the petitioner reduced the rates and was paying tax accordingly. Thereafter, the Government issued G.O.Ms.No.100 Home (General.A) Department, dated 26.04.2013, reclassifying cinema theatres and enhancing the rates of admission. The Government Order also placed some conditions to be adhered to by all theatres and multiplexes.
4. In view of the subsequent Government Order, no further orders are necessary in the present writ petition and the same is accordingly closed. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
