Order:
AS.No.631 of 2013 arises out of judgment and decree, dated 19-03-2013, in OS.No.52 of 2010, on the file of the Court of the learned Senior Civil Judge, Zaheerabad.
Pending the appeal, learned Counsel for the appellant has filed ASMP.No.1517 of 2014 for recording compromise in terms of Memorandum of Compromise entered between the appellant and respondent Nos.1 and 2 (Respondent Nos.1 and 2 are shown to have become majors).
At the hearing, Mr.M.Rama Rao, learned Counsel for respondent Nos.1 and 2, stated that the appellant, who is no other than the father of his clients, has paid money to his clients towards their shares and that therefore, his clients are not interested in contesting the Appeal.
At the hearing, it has come out that respondent Nos.4 and 5 are the purchasers of the suit schedule property from the appellant and that therefore, they have common interest over the said property.
In the light of the above facts, ASMP.No.1517 of 2014 is allowed and the undated Memorandum of Compromise is taken on record. Consequently, AS.No.631 of 2013 is allowed in terms of the said Memorandum of Compromise. The Registry shall draft the decree in AS.No.631 of 2013 in terms of the said Memorandum of Compromise.
As a sequel, interim order, dated 05-09-2013, is vacated and ASMP.No.1770 of 2013, filed by the appellant for interim relief, is disposed of.
