THIS CRL.P COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R Petitioner No.1- Sri. Srinivas Naidu, petitioner No.2- Mrs. Ishita Dasgupta and their counsel Sri. Raj Prabhu. S and Sri. Vijayakumar Majage, learned Addl. SPP for respondent-State are present.
2. The petitioners submit that they have presented a joint petition before this Court under section 482 Cr.P.C. seeking leave of this Court to compound the offences punishable under sections 498A, 323 and 506 IPC, in respect of which FIR is registered in Cr.No.373/2017 in Koramangala police station. In the petition, it is stated that the petitioners have amicably resolved their dispute and petitioner No.2 has withdrawn all the allegations made against petitioner No.1 leading to registration of the above FIR. Petitioner No.2 submits that she has freely and voluntarily withdrawn the allegations made against petitioner No.1 and requests the court to quash the proceedings based on the settlement arrived at between her and petitioner No.1.
3. Having regard to the nature of the allegations made in the FIR and in view of mutual settlement arrived at between the parties, the parties are permitted to compound the alleged offences punishable under sections 498A, 323 and 506 IPC.
As a result, the petition is allowed. Charge Sheet in C.C.No.26783/2017 pending on the file of learned XLV Addl. CMM, Bengaluru is quashed.
