Heard learned counsel for the petitioner; learned Standing Counsel for the respondent no.1; and perused the record.
According to the petitioner he had a house adjoining the national highway in which the second respondent i.e. Zila Sahkari Bank Ltd., was a tenant. The house was demolished on account of widening of national highway. Consequently, on request of respondent bank, certain constructions were raised by the petitioner but the respondent bank is not taking possession of the house.
To direct the respondent bank to take possession of the house, this petition has been filed.
As the prayer in this petition is to enforce a contractual obligation, if any, the appropriate course for the petitioner is to institute a suit.
Subject to above, the petition is dismissed.
It is made clear that we have not expressed any opinion on the merits of the case.
