Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Endowments appearing for the respondents.
This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the respondents in issuing the proceedings Rc.No.SKHB 35/2012, dated 20-8-2013 by the first respondent removing the petitioner from service as illegal, arbitrary, in violation of principles of natural justice and Article 311(2) of Constitution of India.
The petitioner was working as Archaka in Sri Kusuma Haranadha Baba Temple, Bhadrachalam town. On a complaint from the public, an enquiry was made, in the enquiry, he was found guilty and the disciplinary authority removed him from service. Aggrieved thereby, the petitioner filed an appeal before the second respondent on 26-8-2013. The grievance of the petitioner is that even though he filed the appeal long back, the same has not been heard and disposed of.
In view of the submissions made by the learned counsel appearing for the petitioner regarding the delay in disposal of the appeal, the second respondent-appellate authority is directed to hear and dispose of the appeal within a period of six weeks from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
