Civil Misc. Modification Application No. 15 of 2021 This is an application for modifying the order of this Court dated 14.1.2020.
It has been submitted that after the order was passed by this Court on 14.1.2020, the petitioner had deposited the entire decretal amount on 12.2.2020. However, the hearing of the Appeal could not take place on account of the imposition of the lockdown and because of the COVID -19 pandemic.
It has been submitted that hearing of the Appeal was now going on and regular dates were being fixed. An assurance has also been given that the petitioner would be appearing regularly before the Court.
Under such circumstances, it is being provided that the Appeal may now be heard and decided within a period of two months from the date of production of a copy of this order. The copy of this order would be duly certified by the petitioners' counsel.
For a period of three months or till the decision of the Appeal, whichever is earlier, the petitioners shall not be evicted.
It is, however, made clear that the petitioners shall continue to deposit the amounts which are due to to paid.
With these observations, the modification application is disposed of.
