Heard learned counsel for the parties and perused the record.
The instant contempt petition has been filed against the opposite party Sri Bhawani Singh Khagraut, District Magistrate Ballia for flouting the order dated 30.5.2018 passed by the writ Court.
It is contended by learned counsel for the applicant that pursuant to the order of the writ Court, opposite party vide order dated 24.8.2018 has rejected the representation of the petitioner. It is urged that dismissal of the representation is the violation of the decision rendered by the writ Court.
Be that as it may, the contempt court cannot sit in appeal over the decision of the opposite party. The applicant has to take appropriate remedy available in law against the order passed by the opposite party.
The contempt petition is, accordingly, dismissed.
