Heard Shri Kripa Shanker Mishra, learned counsel for the petitioner and the learned standing counsel for the respondents no. 1 to 4.
The petitioner is seeking a direction to the respondents to remove the names of the respondents no. 5 to 9 from the House no. 46 of the Family Register of the petitioner. In this regard the petitioner is stated to have submitted an application before the Block Development Officer, Azamgarh on 29.11.2016, Annexure 2 to the writ petition by registered post of the same date but no orders have been passed thereon.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no. 3-Block Development Officer, Phoolpur District Azamgarh to consider and decide the petitioner's application dated 29.11.2016 in accordance with law within a period of three months from the date of receipt of the certified copy of this order.
Alongwith certified copy of this order, the petitioner shall also provide a copy of the application dated 29.11.2016 to the respondent no. 3.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
