JUDGMENT / ORDER

Hon'ble Vedpal,J.
Sri M.N. Rai, learned counsel for the petitioners at the very outset stated that he does not intend to file rejoinder affidavit to the counter affidavit filed by the opposite party no. 3.
Heard learned counsel for the petitioners and learned Additional Government Advocate. Gone through the writ petition.
The present writ petition has been filed with the prayer for quashing First Information Report relating to case crime no. 158 of 2010 under Section 467, 468, 323 and 506 IPC of Police Station Itaunja, district Lucknow.
We have gone through the contents of the First Information as well as the counter affidavit filed by opposite party no. 3. The allegations in the FIR are that petitioner Shrikant Trivedi had fradulently obtained signatures of his mother on blank papers with a view to get illegal benefit of the same.
Since the allegations made in the FIR disclose commission of cognizable offence, as such, the same cannot be quashed.
The writ petition is accordingly dismissed.
However it is provided that if Smt. Rajesh Trivedi, petitioner no. 2 surrenders before the Court below and move application for bail, she being a lady, her bail application shall be considered and disposed of expeditiously by the court below giving her the benefit of Section 437 Cr.P.C.
It is further directed that if petitioners Shrikant Trivedi and Pankaj Trivedi appear before the court below and move application for bail, their bail application shall be heard and disposed of expeditiously by the Courts below.
