THIS PETITION COMING ON FOR ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R The petitioner has sought for a direction to the respondents to permit change of branch from Mechanical Engineering to Computer Science.
2. The petitioner claims to be a student of Engineering pursuing his education in Mechanical Engineering at the second respondent college. It is submitted that the petitioner has desired to pursue his Engineering in Computer Science/Electronics and Communication/Information Science and Engineering. Accordingly, after commencement of third semester, the petitioner applied for change of branch from the academic year 2019-20 from Mechanical Engineering to Computer Science as a first option and to Electronics and Communication/Information Science and Engineering as subsequent options.
3. The application was submitted through the respondent No.2 – College along with the prescribed fees. The petitioner was permitted to attend the classes of Computer Science branch. It is submitted that now the petitioner has been orally informed that the respondent No.1- University has not approved the change of branch and he has been directed to attend the classes of Mechanical Engineering by the Respondent No.2 – College. Hence, the present writ petition.
4. It is the grievance of the petitioner that no written communication is made either to the
petitioner by the respondent No.1 – University.
5. It is needless to observe that on the application submitted by the petitioner, a decision has to be taken by the respondent No.1 – University by assigning reasons and the same has to be communicated. No oral instructions/directions could be issued to the petitioner-student without there being a decision communicated by a speaking order.
6. In the circumstances, the respondent No.1 – University shall re-consider the application of the petitioner submitted through the respondent No.2 – College and take a decision by passing a speaking order and the same shall be communicated to the petitioner in an expedite manner in any event not later than two weeks from the date of receipt of certified copy of the order.
Writ petition stands disposed of in terms of the above.
