RESPONDENTS THESE WRIT PETITIONS ARE FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE R-1 TO CONSIDER THE PROPOSAL SUBMITTED BY THE R-2 IN THE PROPOSAL DATED 25.11.2013 VIDE ANNEXURE-N WITHIN A TIME FRAME SPECIFIED BY THIS HON’BLE COURT; AND ETC.
THESE WRIT PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER The short grievance of the petitioners is against the non-consideration by the first respondent of the proposal dated 25.11.2013 sent by the 2nd respondent recommending the case of the petitioners for their inclusion for the Salary Grant.
Sri. M.V.Ramesh Jois, the learned AGA appearing for the answering respondent having opposed the writ petition initially now submits that if a reasonable period is prescribed by this Court for considering the said proposal, there would not be much difficulty for accomplishing the task in question provided that petitioners and their institution also cooperate by furnishing the information/documents as are required for due consideration. This stand of the respondents is fair & reasonable.
With the above observations, these writ petitions are disposed off directing the first respondent to consider the proposal dated 25.11.2013, a copy whereof is at Annexure-N within a period of three months, in accordance with law and to inform the petitioners individually the result thereof, without fail.
It is open to the official respondents to solicit any information or document from the side of petitioners as are required for the consideration, of the proposal, however, subject to the rider that in the guise of such solicitation, delay shall not be brooked.
All contentions of the parties are kept open.
