Heard learned counsel for the parties.
The impugned order dated 30.8.2014 passed by the respondent No.4 under Section 6 of the Land Encroachment Act is appealable order under Section 10 of the said Act. Since the petitioner has efficacious alternative remedy of appeal, therefore, there is no apparent reason to entertain this writ petition under the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India.
In order to enable the petitioner to approach the appellate authority and seek appropriate interim relief, the impugned order shall remain stayed for a period of one week from today, within which the petitioner is at liberty to take appropriate steps to approach the appellate authority.
The writ petition is disposed of accordingly. Miscellaneous applications, if any, shall stand closed. No costs.
