Shankarappa and Also D/o N.Venkatarayappa, Aged about 26 years, Gurampalli Village, Mittahalli Post, Chilakalanerpu Hobli, Chintamani Taluk, Chickaballapur District – 563 135. …Respondent (By Shri. N. Shankarappa, Advocate) This Criminal Petition is filed under Section 482 of Cr.P.C. praying to set aside the order dated 15.09.2016 passed by the II Addl. District and S.J., Chikkaballapura sitting at Chintamani in Crl.R.P.No.41/2016 and Crl.R.P.No.25/2016 by allowing this Crl.P.
This Petition coming on for admission this day, the Court made the following:-
O R D E R Heard the learned counsel for the petitioner. The petitioner is said to be the husband who is restrained from his wife as his wife has sought for maintenance which was ordered at Rs.2,500/- which was further enhanced by the lower appellate court to Rs.5,000/-. Hence the petitioner is before this court. He is said to be employed as conductor with the Transport Corporation of the State and would be earning a handsome salary and he can well afford to pay his wife a sum of Rs.5,000/-. Therefore there is no warrant for interference. The petition is rejected.
