Heard learned counsel for the petitioner.
The petitioner has sought impleadment in a suit for injunction which has been instituted by the respondents herein. He claims to have filed an application seeking relief with respect to certain obstructions which have been created by the plaintiff upon the suit property. The Court finds itself unable to countenance the maintainability of that application made by the petitioner in a suit in which he is a defendant. If the respondents herein are interfering in any manner with the enjoyment of the property of the petitioner or his right of way, his remedy clearly lies else where and not in a suit which is instituted by the respondents herein.
The petition is thoroughly misconceived and is dismissed.
