(By Sri.R.D.Renukaradhya, HCGP for R1) …Petitioner ..Respondents This Criminal Petition is filed under Section 482 of Cr.P.C., praying to quash the entire proceedings in C.C.No.1423/2018 on the file of the Principal Civil Judge and Judicial Magistrate First Class, Chitradurga including, FIR and complaint in Cr.No.628/2016 registered by the First respondent police on the basis of the complaint lodged by the second respondent For the offence P/U/S 295A, 505(2) and 511 of the IPC and all further proceedings pursuant thereto, which are produced herewith and marked as documents 1, 2, 3 and 4 respectively.
This Criminal Petition is coming on for Admission, this day, the Court made the following:-
ORDER Learned State Counsel was directed to get instructions as to whether is there any compliance to Section 196 of IPC. He has instructions that the matter is pending before the competent authority to proceed further in terms of Section 196 of IPC. Consequently, FIR in Crime No.628/2016 and complaint in CC No.1423/2018 vide documents 1, 2, 3 and 4 are set aside. Criminal petition stands allowed. The disposal of this petition would not come in the way of taking further steps by the competent authority in accordance with law.
