…Respondents (By Sri.K.P.Yoganna, HCGP for R1 Sri.Nishit Kumar Shetty, Advocate for R2) This Criminal Petition is filed under Section 438 of Cr.P.C. praying to enlarge the petitioners on bail in their event of his arrest in Cr.No.32/2019 of Lakkavalli Police Statin, Chikkamagaluru for the offence p/u/s 143, 147, 341, 302 r/w Sec.149 of IPC and Sec.3(1)(r), 3(1)(s), 3(2)(va) of SC/ST Amended Act, 2015.
This Criminal Petition coming on for Orders this day, the Court made the following:
O R D E R It is submitted by learned HCGP for the respondent- State that, earlier while registering the case in Crime No.32/2019, this petitioner’s name was also implicated for the offences punishable under Sections 143, 147, 341, 302 read with Section 149 of IPC. But at the time of filing the charge-sheet, the name of this petitioner is deleted. He is not arraigned as accused in the charge sheet.
In view of the submission of learned HCGP, the petition under Section 438 of Cr.P.C., does not survive for consideration. Accordingly, petition stands dismissed.
