SPP for R-1 R-2 served and unrepresented) This Criminal petition is filed under Section 482 of Cr.P.C. praying to quash the proceedings in Cr.No.18/2012 on the file of 1st Respondent, Sampigehalli Police, Bangalore city, for the offences p/u/Ss. 427 and 447 of IPC as against the petitioner.
This Criminal petition coming on for orders, this day, the Court made the following:
O R D E R Counsel for petitioner has filed a Memo reporting death of the sole accused. Copy of the Death Certificate issued by the Registrar of Births and Deaths produced along with the Memo discloses that the petitioner namely, the accused died on 22.07.2017.
2. In view of the said Memo and the death certificate produced by the counsel for the petitioner, the proceedings against the petitioner in Crime No.18/2012 on the file of Sampigehalli Police Station, Bangalore, are dismissed as abated. Consequently, the petition is also dismissed as abated.
