RESPONDENT THIS CIVIL PETITION IS FILED UNDER SECTION 24 OF CPC PRAYING TO WITHDRAW THE MC PETITION NO.46/2016 PENDING ON THE FILE OF THE SENIOR CIVIL JUDGE AND JMFC AT BHADRAVATHI AND TRANSFER THE CASE TO FAMILY COURT AT BENGALURU AND ETC., THIS CIVIL PETITION COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R This petition is filed by the respondent-husband seeking for transfer of M.C.No.46/2016 pending on the file of Civil Judge (Sr. Dn.) & JMFC, Bhadravathi, to Family Court, Bangalore.
2. Learned Advocates appearing for parties after arguing the matter for sometime have filed a Joint Memo, which is duly signed by the petitioner as well as respondent, whereunder it is agreed between the parties that consent divorce petition under Section 13-B of the Hindu Marriage Act, 1955, would be filed by them before the Civil Judge (Sr.Dn.) & JMFC, Bhadravathi, in M.C.No.46/2016. It is also stated by the parties that they have mutually agreed that they do not have any claim against each other and as such, they have prayed for suitable orders being passed on said memo and have also sought for this petition being disposed of.
3. Parties are present before Court and they are identified by their respective learned Advocates. Parties present before Court submit that contents of joint memo are true and correct and out of their own free will and without any force, threat or coercion they have filed said Joint Memo. In that view of the matter, Joint Memo is placed on record and civil petition stands disposed of accordingly.
Registry is directed to communicate this order to the jurisdictional Family Court enclosing photocopy of the Joint Memo filed by the parties and transmit the same to the Civil Judge (Sr.Dn.) & JMFC, Bhadravathi, for being kept in M.C.No.46/2016. Registry of trial Court shall duly enter in the order sheet the gist of order passed in this petition.
