THIS PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE CHIEF JUSTICE MADE THE FOLLOWING:
ORDER Issue notice to the respondents.
2. Mr.V.G.Bhanuprakash, learned additional government advocate, accepts notice for both the respondents. Therefore, formal service of notice of the writ petition to them is dispensed with.
3. This is a writ petition, in substance, seeking a direction to the respondents to pay interest at the rate of 12% per centum per annum accrued on the earnest money deposit made by the writ petitioner.
4. Mr.Bhanuprakash submits, on instructions, that the authorities have agreed to pay a sum of `3,04,82,403/- (Rupees three crore four lakh eighty two thousand four hundred and three) only, which is the interest accrued on the earnest money deposit, within eight weeks.
5. Mr.B.V.Acharya, learned senior advocate appearing for the petitioner, accepts the offer of payment of the said sum, by eight weeks.
6. As prayed for, the writ petition is disposed of by directing the respondents to pay to the petitioner a sum of `3,04,82,403/- (Rupees three crore four lakh eighty two thousand four hundred and three) only within eight weeks from the date of communication of this order, by issuing an account payee cheque, or by transferring the amount in the bank account of the writ petitioner.
7. We make no order as to costs.
