(BY MR.VIJAY KUMAR A PATIL, AGA FOR R1-R5) … RESPONDENTS THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE ROWDY SHEET OPENED AND MAINTAINED AGAINST THE PETITIONER IN THE R-5 OF ANNEX-E DTD.20.10.2017 AND ETC.
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri.Vinod kumar.M, learned counsel for the petitioner.
Sri.Vijay Kumar A.Patil, learned Additional Government Advocate for respondent Nos.1 to 5.
2. The petition is admitted for hearing. With consent of the learned counsel for the parties, the same is heard finally.
3. In this petition under Articles 226 and 227 of the Constitution of India, the petitioner has inter alia prayed for a writ of certiorari to quash the Rowdy Sheet opened and maintained against the petitioner in the police station.
4. When the matter is taken up today, learned counsel for the petitioner submitted that in all the cases which were initiated against him, the petitioner has been acquitted and has been granted a liberty to approach the Deputy Commissioner of Police, Bengaluru and directed the Deputy Commissioner of Police, Bengaluru to consider the representation to be submitted by the petitioner.
5. Learned Additional Government Advocate submits that if any representation is submitted, same will be considered in accordance with law.
6. In view of submission made and the facts of the case, petition is disposed of with liberty to the petitioner to submit a representation within two weeks from the date of receipt of a copy of this order. The representation submitted by the petitioner shall be dealt with by passing a speaking order within a period of three weeks thereafter.
It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the Petition is disposed of.
