JUDGMENT: (per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta)
We do not find any illegality or infirmity with the impugned order of the learned trial Judge. It is however open for the appellants to approach the learned trial Judge to hear and dispose of the matter as per the submissions made before us.
As the learned counsel for the appellants argued that the vacate petition has been filed before the learned trial Judge, we feel that this is sheer abuse of process of the Court.
Hence, the appeal is dismissed with costs assessed at Rs.1,000/- (Rupees One Thousand only) to be paid by the appellants to the respondents within a week from date.
Pending miscellaneous petitions, if any, shall stand closed.
