Heard Sri R.K. Singh, learned counsel for the applicant and Sri Amit Sinha, learned A.G.A. for the State-respondent.
This application under Section 482 Cr.P.C. has been filed by the applicant seeking quashment of charge-sheet dated 04.12.2017, arising out of Crime No.573 of 2017, under Sections 332, 353, 504 & 506 IPC, P.S. Shivpur, District Varanasi as well as cognizance/summoning order dated 13.6.2018 passed by VI Additional Chief Judicial Magistrate, Varanasi and the entire proceedings of Criminal Case No.2059 of 2018 (State vs. Reena Singh).
After arguing the matter for some time, learned counsel for the applicant wants to withdraw this application with liberty to file regular bail application before the trial court. He submits that a direction may be issued to the trial court to decide the bail application on the same day or at least by the next date, so that the applicant may not suffer any further injury.
Learned A.G.A., however submits that discretion be given to the trial court to decide the bail application in accordance with law.
This application is accordingly dismissed, as withdrawn with the aforesaid liberty.
Needless to state that in the eventuality of filing any such application, the competent court shall decide the same strictly in accordance with law.
