FOR R2 AND R3) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE R3, KOPPA GRAMA PANCHAYATH TO CONSIDER HIS REPRESENTATIONS DATED 28.10.2014 AT ANNEXURE-A AND FURTHER DIRECT THEM TO INSERT HIS PROPERTY IN E PROPERTY LIST.
THIS WRIT PETITION COMING ON FOR ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Mr. B.S.Nagaraj, Adv. for Petitioner Mr. A.K.Vasanth, AGA for R1 Mr.B.J.Somayaji, Adv. for R2 and R3 This petition has been filed with the following prayers:
i. Issue a writ in the nature of Mandamus or any other appropriate writ directing the Respondent No.3, Koppa Grama Panchayath to consider his representations dated 28.10.2014 at Annexure-A and further direct them to insert his property in E property list;
ii. Further direct the Respondent No.2-the Executive officer to consider his application (Appeal) dated 13.11.2014 at Annexure-B for proper instruction to the Respondent No.3 and iii. pass such other order or orders as this Hon’ble Court may deems fit to grant in the circumstances of the case and allow this writ petition with costs, in the interest of justice and equity.”
2. Mr.B.J.Somayaji, learned counsel appearing for the Respondents-2 and 3 Gram Panchayat, submits that the representation of the petitioner has been considered and disposed of on 24.02.2015 and a copy of the said Resolution has been given to the petitioner.
3. The writ petition is therefore dismissed as infructuous. If the petitioner is aggrieved by the said Resolution, he shall be free to take recourse as per Law.
