CMM, Bengaluru.
This petition is coming on for admission this day, the Court made the following:-
ORDER In the instant petition, petitioner has sought for the following relief:
Quash the charge sheet submitted by the 1st respondent Police in CC No.26523/2015 for alleging offence punishable U/S 341, 504, 323, 354, 506 of IPC pending on the file of LVI Additional Chief Metropolitan Magistrate, Bengaluru City, in the interest of justice and equity.
2. Learned counsel for the petitioner submitted that petitioner is brother-in-law of the complainant. There are certain disputes relating to financial transaction to the extent of Rs.46,40,000/-. In this regard, petitioner has filed a suit for recovery of money. In the suit, execution of warrant relating to property attachment was ordered and it was given effect on 29.9.2015 at 11.00 a.m. After execution of attachment warrant, 2nd respondent filed a complaint before the Girinagar Police Station. Gist of the complaint reads as under:

3. Perusal of the allegations that petitioner had handled the 2nd respondent’s hand and pulled and assaulted. The allegation, prima facie, is very vague. That part, nature of injury sustained by the 2nd respondent has not been stated in the complaint. In this backdrop of execution of property attachment on 29.9.2015 at 11.00 a.m, filing of complaint on the same day by the 2nd respondent at 12.00 noon is prima facie an after thought and to harass petitioner. That apart, there is no specific statement made in the complaint that what kind of injury was suffered by her. Respondent has not made out prima facie case for the alleged offences punishable under Sections 341, 504, 323, 354, 506 of IPC.
Accordingly, petition stands allowed. Consequently, charge sheet filed against the petitioner by the 1st respondent Police in CC No.26523/2015 for offences punishable under Sections 341, 504, 323, 354, 506 of IPC pending on the file of LVI Additional Chief Metropolitan Magistrate, Bengaluru City is hereby quashed.
