Arun G., Advocate [absent]) This Criminal Revision Petition is filed under Section 397 read with 401 of Cr.P.C., pleased to set aside the judgment and order dated 12.10.2018 in Crl.A.No.25151/2017 passed by the XXVIII Additional City Civil Judge, Mayohall Unit, Bengaluru which confirmed the judgment and order dated 06.10.2017 in C.C.No.55877/2016 on the file of the LVIII A.C.M.M., Bengaluru and thereby acquit the petitioner for charge framed.
This Criminal Revision Petition is coming on for Orders, this day, the Court made the following:
O R D E R Both the counsels are absent.
2. Though the learned counsel for the petitioner has filed a memo reporting compromise, the said compromise petition is not signed by the respondent and his counsel. In the said memo, it has been mentioned that during the pendency of the present revision petition, at the instance of well-wishers and friends they are agreed to settle the matter amicably for one time settlement amount of Rs.4,25,000/-. It is further stated that an amount of Rs.75,000/- deposited before the Court of LVIII Additional Chief Metropolitan Magistrate, Mayohall Unit, Bengaluru in C.C.No.55877/2016 may be released in favour of the respondent/complainant and the petitioner undertakes to give an amount of Rs.2,00,000/- on 20.02.2019 and the remaining amount of Rs.1,50,000/- on 16.04.2019.
3. The said memo is placed on record.
4. In view of the settlement arrived between the parties, the petition is disposed of and the trial Court is directed to release an amount of Rs.75,000/- in favour of the respondent/complainant on proper identification and acknowledgment.
