JUDGMENT / ORDER

THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.20583 0f 2003 Between:
Sri Shanti Steel Centre, Rep. by its Partner, Ramesh Kumar Jain PETITIONER AND
1. Union of India, Ministry of Telecommunications, New Delhi rep. by its Secretary, and others.
RESPONDENTS ORDER:
This writ petition is filed seeking the following relief – “….to issue writ of mandamus or any other appropriate writ or direction declaring the award of the 5th respondent passed on 30.07.2003 as illegal arbitrary and consequently set aside the same….”
2. When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner as well as the learned Stand Counsel appearing for the respondents that the matter is squarely covered by the judgment of the Hon'ble Apex Court in Saji

3. Following the same and having regard to the nature of controversy involved in the present writ petition, this writ petition is allowed setting aside the Award dated 30.07.2003 passed by the 5th respondent. It is made clear that the petitioner is entitled for refund of the amount deposited pursuant to the interim orders passed by this Court dated 15.09.2003. No order as to costs. As a sequel, the miscellaneous petitions, if any, shall stand closed.
