THIS WRIT PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R The petitioner is an institution providing industrial training for ITI students. The respondent has issued Notification for the Industrial Training Institute under SCVT for providence of tools and equipments. Application filed by the petitioner-Institution pursuant to the Notification to include the name of the petitioner-institution under SCVT for the year 2016-17 has been considered and rejected. Against the rejection of the petitioner- Institution’s application, this petition is preferred.
2. The learned counsel appearing for the petitioner submits that the requirements to start-up institution, though was in full compliance, the respondents have not considered the same. There are about 75 students who are studying in first and second year batch. The same has been communicated by the petitioner by its letter dated 24th November 2016 to the SCVT in the year 2016-2017. The same has been rejected. The reason assigned for rejection vide endorsement Annexure-B dated 15th June 2016 is “50% shortage in tools and equipments; 60% shortage in space for fitter trade; and 40% shortage in tools and equipments; and 50% shortage in space for electrician trade.” It is stated that the students have joined for first and second year and have to prosecute their studies.
3. The learned Government Advocate supports the impugned order. He submits that in endorsement Annexure-B dated 15th June 2016 it has been referred with regard to the shortage of space, tools and equipments and on the said ground the permission to include the petitioner-institution under SCVT is rejected. There is no error committed by the respondent.
4. Heard the learned counsel for the parties and gone through the reasons assigned in the endorsement. The rejection is on the well-founded reasons. If at all the petitioner is intending to get permission for including it under SCVT, it can make one more application after compliance of the shortage and setting right the anomalies. With these observations, the petition stands disposed of.
