Respondents (By Sri.K.N.Puttegowda, Advocate For R1 & R2) This writ petition is filed under Articles 226 & 227 of the Constitution of India praying to direct the respondents to change the khata of the property bearing No.569 (new No.11) into the name of the petitioner by considering the application of the petitioner dated:22.12.2017 vide Annexure-B.
This writ petition, coming on for Preliminary hearing in ‘B’ group, this day, the Court, made the following:
ORDER In this writ petition, the petitioner has sought the following reliefs:
“a) Issue a writ or order or direction, in the nature of mandamus, directing the respondents to change the Khata of the property bearing No.569 (New No.11) into the name of the petitioner by considering the Application of the petitioner dated:22.12.2017 vide Annexure-‘B’;
b) further be pleased to grant any other relief or reliefs that this Hon’ble court may deems fit under the circumstances of the case along with the costs of this petition, in the interest of justice and equity.”
2. Sri K.N.Puttegowda, the learned counsel appearing for the Corporation has filed a memo along with an endorsement issued on 15.06.2018.
3. The memo is taken on record.
4. In view of the above, the relief sought for by the petitioner does not survive for consideration. Accordingly, writ petition is dismissed reserving liberty to the petitioner to challenge the endorsement dated 15.06.2018, in accordance with law, if so advised.
