ADVOCATE) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE PRELIMINARY NOTIFICATION DTD.26.4.1989 VIDE ANNEX-A & CONSEQUENTLY DIRECT THE RESPONDENTS TO DELIVER BACK, THE PROPERTY BELONGING TO THE PETITIONER WHICH HAS BEEN ACQUIRED, TO THE PETITIONER BY RECEIVING THE AWARD AMOUNT ETC.
THIS PETITION COMING ON FOR ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Learned counsel for petitioner submits that as there are certain defects in drafting the petition, petitioner may be permitted to withdraw the writ petition and file a fresh writ petition.
2. This writ petition has been filed in the year 2016.
Nearly after one year, he wants to withdraw the writ petition. For the fourth time, the matter is listed for non-compliance of office objections.
3. In the circumstances, on payment of costs of Rs.1,500/- to the Prime Minister’s National Relief Fund within two weeks, writ petition is dismissed as withdrawn.
Liberty is reserved to petitioner to file a fresh writ petition on same cause of action within three weeks from today.
