The Manager National Insurance Company Limited Sri Manjunatheshwara Complex Old Bus Stand Road Hassan 573 201 …Appellant …Respondents (by Shri Janardhan Reddy, Advocate for R2) This Miscellaneous First Appeal is filed under Section 173(1) of the Motor Vehicles Act, against the judgment and award dated 09.03.2015 passed in MVC No.1082/2013 on the file of the Court of II Additional District and Sessions Judge and Additional MACT, at Hassan partly allowing the claim petition for compensation and seeking enhancement of compensation.
This Miscellaneous First Appeal coming on for Admission, this day, the Court delivered the following:
J U D G M E N T The appeal is by the claimant seeking enhancement in the compensation. For the injuries suffered in the road traffic accident that occurred on 16th January 2013, the petitioner made claim petition. The Motor Accident Claims Tribunal, Hassan by its order dated 9th March 2015 passed in MVC No.1092 of 2013 awarded compensation of Rs.1,09,267/-. Being not satisfied with the compensation awarded, the claimant has preferred this appeal.
2. After arguing the matter for consideration length of time, both the learned counsel appearing for the parties submit that the matter may be disposed of by awarding global compensation of Rs.1,25,000/-. The said submission is placed on record. A global amount of Rs.1,25,000/- is awarded in addition to what has been awarded by the Tribunal. The enhanced compensation does not carry interest. Appeal is accordingly allowed in part.
