Learned counsel for the petitioner-institution has not been able to file an affidavit on behalf of the petitioner institution disclosing as to whether a playground is existing in the campus of the institution consistent with various Government Orders, the provision of Right of Children to Free and Compulsory Education Act, 2009 as well as law laid down by this Court in Writ C No. 4400 of 2019 (M/S G.S. Convent School Vs. State of U.P. and others), despite direction of this Court on 21.09.2021.
The writ petition is dismissed with liberty to file a fresh writ petition after bringing the aforesaid facts in the record.
